1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of https://getagentdeck.com and related services, products, software, websites, and applications collectively referred to as the “Services.”

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

By using the Services, you represent that you meet this requirement and have authority to enter into these Terms.

5. User Content

You represent that you have all rights necessary to submit User Content and that your User Content does not violate law or third-party rights.

6. Prohibited Content

You may not submit content that:

  • Is unlawful, defamatory, fraudulent, or misleading

  • Infringes intellectual property rights

  • Contains malware or harmful code

  • Violates privacy or publicity rights

  • Promotes violence, exploitation, or illegal activity

  • Contains spam or unauthorized advertising

  • Is otherwise harmful to users, the Services, or us

We may remove content or restrict access at our discretion.

7. Intellectual Property

The Services, including software, designs, text, graphics, logos, trademarks, and other materials, are owned by us or our licensors and are protected by intellectual property laws.

Except as expressly permitted, you may not copy, modify, distribute, sell, lease, sublicense, or create derivative works from the Services.

8. Software and Beta Features

If we provide downloadable software, APIs, plugins, developer tools, beta features, or experimental services, they may be subject to additional terms.

Beta or experimental features may be incomplete, unstable, or discontinued at any time.

We provide beta and experimental features “as is” without guarantees.

9. Payments and Subscriptions

Some Services may require payment.

By purchasing paid Services, you agree to:

  • Pay all applicable fees

  • Provide accurate billing information

  • Authorize us or our payment processor to charge your payment method

  • Pay applicable taxes unless otherwise stated

Subscription fees may renew automatically unless canceled before renewal.

Refunds are provided only as stated on the applicable order page or as required by law.

The Services may integrate with or link to third-party services.

We are not responsible for third-party services, content, data practices, availability, or security.

Your use of third-party services may be governed by separate terms and policies.

11. Service Availability

We may modify, suspend, or discontinue any part of the Services at any time.

We do not guarantee uninterrupted or error-free operation.

We are not liable for outages, data loss, delays, or failures caused by events beyond our reasonable control.

12. Security

You may not attempt to compromise the security of the Services.

If you discover a vulnerability, you agree to report it responsibly to security@getagentdeck.com and not exploit or disclose it publicly without authorization.

13. Termination

We may suspend or terminate your access to the Services if:

  • You violate these Terms

  • Your use creates legal, security, or operational risk

  • Required by law

  • We discontinue the Services

You may stop using the Services at any time.

Certain provisions will survive termination, including intellectual property, payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions.

14. Disclaimers

The Services are provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, and security.

We do not guarantee that the Services will meet your requirements, be uninterrupted, error-free, secure, or free from harmful components.

15. Limitation of Liability

To the fullest extent permitted by law, AGENT DECK and its owners, officers, employees, contractors, agents, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, business interruption, or loss of goodwill.

Our total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:

  • The amount you paid us for the Services in the three months before the claim arose; or

  • $100

Some jurisdictions do not allow certain limitations, so some of the above may not apply.

16. Indemnification

You agree to defend, indemnify, and hold harmless AGENT DECK and its owners, officers, employees, contractors, agents, affiliates, and licensors from claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from:

  • Your use of the Services

  • Your User Content

  • Your violation of these Terms

  • Your violation of law

  • Your infringement of third-party rights

17. Governing Law

These Terms are governed by the laws of Colorado, USA, without regard to conflict-of-law principles.

Any disputes will be resolved in the state or federal courts located in Denver County, Colorado, unless applicable law requires otherwise.

18. Changes to These Terms

We may update these Terms from time to time.

The updated version will be posted on this page with a revised effective date.

Continued use of the Services after changes means you accept the updated Terms.
